1. Acceptance of Terms

These Terms of Use ("Terms") govern your access to and use of the website jenntc.co.za, including all associated pages, learning materials, recorded video lessons, and any related services (collectively, the "Platform"), operated by JENN Training and Consultancy (Pty) Ltd, a company registered in the Republic of South Africa ("JENNTC", "we", "us", or "our").

By accessing, browsing, or otherwise using the Platform, you ("User", "you", "your") agree to be bound by these Terms. If you do not agree to these Terms, you must not access or use the Platform.

If you are accessing the Platform on behalf of a school, district, or other organisation, you confirm that you have the authority to bind that organisation to these Terms.

2. Description of the Platform

JENNTC provides:

• Digital learning materials (study guides, notes, and related documents) for the following subjects: Mathematics, Mathematical Literacy, Technical Mathematics, Technical Science, Physical Sciences, Agricultural Sciences, Life Sciences, Geography, History, Accounting, Business Studies, Economics, Sesotho Puo Ya Lapeng, and English First Additional Language;
• Recorded video lessons, organised by subject and topic, made available directly on the Platform and/or via linked third-party platforms (e.g., YouTube).

The Platform is intended to supplement, not replace, formal classroom instruction, textbooks, or guidance from qualified teachers and curriculum advisors.

3. No Guarantee of Outcomes — Educational Disclaimer

3.1. The materials and video lessons on the Platform are provided for general educational support and self-study purposes only. While we take reasonable care in preparing and curating content, JENNTC makes no representation, warranty, or guarantee — express or implied — regarding:

• any specific examination result, pass rate, grade, or academic outcome;
• the completeness, accuracy, or currency of any material relative to the current official curriculum (e.g., CAPS) at any given time;
• the suitability of any material for a particular learner's specific needs.

3.2. Academic performance depends on numerous factors outside our control, including but not limited to individual learner effort, classroom instruction, prior knowledge, examination conditions, and changes to curricula or examination bodies. JENNTC shall not be held responsible or liable for any learner's academic results or examination performance, or any consequence arising from reliance on, use of, or inability to access the Platform or its content.

3.3. Users are responsible for verifying any material against official curriculum documents, past papers, and guidance issued by the Department of Basic Education or relevant examination bodies before relying on it for formal assessment preparation.

3.4. Where free access to seasonal (Spring, Winter, Autumn, or "Last Push") materials is provided, this is offered as a goodwill educational supplement, and no fee-for-outcome relationship is created between JENNTC and any User.

4. Acceptable Use

You agree that you will not:

• use the Platform for any unlawful purpose or in violation of any applicable South African law;
• attempt to gain unauthorised access to any part of the Platform, its systems, or databases;
• probe, scan, or test the vulnerability of the Platform, or attempt to breach any security measures, except as separately authorised in writing by JENNTC;
• upload or introduce any virus, malware, or harmful code;
• copy, reproduce, republish, distribute, sell, or exploit any content from the Platform for commercial purposes without our prior written consent;
• use automated means (bots, scrapers) to access or extract content from the Platform without permission;
• interfere with or disrupt the Platform's operation or servers.

Violation of this section may result in immediate suspension or restriction of access to the Platform, at our discretion.

5. Intellectual Property

5.1. All learning materials, video lessons, text, graphics, logos, and other content on the Platform (excluding third-party content linked to, such as YouTube videos hosted on YouTube's own platform) are the property of JENNTC or its licensors and are protected by South African and international copyright law.

5.2. Users are granted a limited, non-exclusive, non-transferable, revocable licence to access and use the materials for personal, non-commercial, educational purposes only (e.g., a teacher's own classroom use, or a learner's own study).

5.3. You may not reproduce, distribute, sell, sub-license, or create derivative works from Platform content without our prior written permission.

6. Third-Party Links and Content

The Platform may contain links to, or embedded content from, third-party websites or platforms (such as YouTube). JENNTC does not control and is not responsible for the content, accuracy, availability, or practices of any third-party site. Your use of third-party platforms is subject to their own terms and privacy policies.

7. Limitation of Liability

7.1. To the maximum extent permitted by South African law, JENNTC, its directors, employees, and affiliates shall not be liable for any direct, indirect, incidental, special, consequential, or punitive damages arising from or related to:

• your access to, use of, or inability to access or use the Platform;
• any error, inaccuracy, omission, or defect in any material or content;
• any academic or examination outcome connected to use of the Platform;
• any unauthorised access to or alteration of any data submitted through the Platform, to the extent not caused by our gross negligence or wilful misconduct;
• any interruption, suspension, or discontinuation of the Platform.

7.2. The Platform and all content are provided "as is" and "as available", without warranties of any kind, whether express or implied, including but not limited to warranties of merchantability, fitness for a particular purpose, or non-infringement.

7.3. Nothing in these Terms limits or excludes liability that cannot lawfully be limited or excluded under South African law, including liability for gross negligence, wilful misconduct, or fraud.

8. Indemnity

You agree to indemnify and hold harmless JENNTC, its directors, employees, and affiliates from and against any claims, losses, liabilities, damages, costs, or expenses (including reasonable legal fees) arising from your breach of these Terms, your misuse of the Platform, or your violation of any law or third-party right.

9. Data Collection and Privacy

The Platform does not require registration to access learning materials or video lessons. We may, however, collect limited technical information (such as browser and usage data via analytics tools) and any information you voluntarily provide to us (for example, through a contact form). This information is processed in accordance with the Protection of Personal Information Act (POPIA).

Full details of what we collect, why, and how it is protected are set out in our separate Privacy Policy, which forms part of these Terms by reference. By using the Platform, you also agree to the Privacy Policy.

10. Changes to These Terms

We may update these Terms from time to time to reflect changes in our services, legal requirements, or operating practices. The updated version will be posted on this page with a revised "Last Updated" date. Continued use of the Platform after changes are posted constitutes your acceptance of the revised Terms.

11. Governing Law and Jurisdiction

These Terms are governed by and construed in accordance with the laws of the Republic of South Africa. Any disputes arising from these Terms or your use of the Platform shall be subject to the exclusive jurisdiction of the South African courts.

12. Severability

If any provision of these Terms is found to be invalid or unenforceable by a court of competent jurisdiction, that provision shall be limited or eliminated to the minimum extent necessary, and the remaining provisions shall remain in full force and effect.
